Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of all services offered by EchoForge at echoforge.biz ("Services"), including WCAG accessibility audits, market audits, and podcast content production. By placing an order or submitting a sample request you agree to these Terms in full. If you are ordering on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Services

• 2.1 WCAG Accessibility Audit. A review of your website against WCAG 2.1 AA/AAA criteria. Delivered as a PDF report within 24 hours of a confirmed order. Scope is either a 5-page audit or a full-site audit as selected at order time.
• 2.2 Market Audit. A competitive market analysis report for your business or product, delivered by email within the timeframe stated at order time.
• 2.3 Podcast Content Production. Production of podcast-ready content packages delivered to your email within 24 hours of a confirmed order. Sample output is watermarked; full unbranded packages are delivered after purchase.
• 2.4 Free Samples. All services offer a free sample. Samples are limited to one per email address per day. Samples may be censored, watermarked, or otherwise limited compared to paid output.
• 2.5 Service availability. EchoForge reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice where possible.

3. Ordering and Payment

• 3.1 Paid orders are processed via Fiverr. By completing an order you agree to Fiverr's Terms of Service in addition to these Terms. EchoForge does not store your payment information.
• 3.2 Prices displayed on echoforge.biz are in US dollars and are subject to change at any time. The price applicable to your order is the price displayed at the time you initiate the order.
• 3.3 Your order is confirmed when payment is received. Delivery timelines stated on the website begin from the time of order confirmation, unless a verification step is required (e.g. for security audits).

4. Delivery

• 4.1 Reports and content packages are delivered by email to the address you provide at order time. You are responsible for ensuring the email address is correct.
• 4.2 If you do not receive your delivery within the stated timeframe, check your spam folder and contact us at hello@echoforge.biz.
• 4.3 Delivery timelines are estimates. Delays caused by circumstances outside our reasonable control (e.g. infrastructure outages, force majeure) do not constitute a breach of these Terms.

5. Refund Policy

• 5.1 Before work begins. A full refund is available if requested before EchoForge has begun work on your order. Contact us promptly at hello@echoforge.biz.
• 5.2 After delivery. No refund is available once your report or content package has been delivered, except where the deliverable is materially different from what was described on the website at the time of order.
• 5.3 Non-delivery. If we fail to deliver within twice the stated timeframe for reasons attributable to EchoForge, you are entitled to a full refund.
• 5.4 Refund requests should be submitted to hello@echoforge.biz with your order details.

6. Acceptable Use

• 6.1 You must only submit URLs, domains, or content that you own or have explicit authorisation to have audited or analysed. Submitting third-party assets without permission may violate applicable laws.
• 6.2 You must not use our services for any unlawful purpose, or to violate the rights of any third party.
• 6.3 You must not attempt to abuse free sample limits or use automated means to submit requests.
• 6.4 EchoForge reserves the right to refuse or cancel any order that violates these Terms, with a full refund issued where payment has been made.

7. Intellectual Property

• 7.1 Your content. You retain all rights to the URLs, content, and materials you submit to EchoForge. By submitting them you grant EchoForge a limited, non-exclusive licence to use them solely for the purpose of performing the service you ordered.
• 7.2 Delivered reports. Upon full payment, EchoForge grants you a non-exclusive, non-transferable licence to use the delivered report or content package for your own internal business purposes. You may not resell, redistribute, or sublicense the deliverable without prior written consent from EchoForge.
• 7.3 EchoForge brand and website. All trademarks, logos, and content on echoforge.biz are the property of EchoForge. Nothing in these Terms grants you any right to use the EchoForge name or brand.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available". EchoForge makes no warranties, express or implied, including but not limited to:

• That reports will identify every accessibility issue, vulnerability, or compliance gap present on your website.
• That following the recommendations in a report will guarantee legal compliance with any specific regulation.
• That the Services will be uninterrupted, error-free, or available at any particular time.

Reports represent a professional assessment at the point in time the analysis was performed. Websites change; a report does not remain valid indefinitely.

9. Limitation of Liability

To the maximum extent permitted by applicable law, EchoForge's total aggregate liability for any claim arising from or related to the Services is limited to the amount paid by you for the specific order giving rise to the claim.

EchoForge is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or reputational harm, even if EchoForge has been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless EchoForge, its operators, and its affiliates from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the Services, your breach of these Terms, or your submission of content or URLs you did not have the right to submit.

11. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.

12. Changes to These Terms

EchoForge reserves the right to update these Terms at any time. Changes will be posted at this URL with a revised effective date. Continued use of the Services after a change constitutes acceptance of the updated Terms. Orders placed prior to a change are governed by the Terms in effect at the time of order placement.
